The Vibrations That Sing

This Release is made between RobProPhoto LLC ("Producer") and the undersigned adult volunteer ("Participant"). The parties will sign this document at the session.

1. Session. Participant agrees to take part in an audio and video recording session at a public café or similar public place in the Portland, Oregon area. Producer records close-up ("macro") audio and video of everyday objects and of actions with them, for example tapping a table, swirling a drink, sliding along a bench, dropping a book or turning a page, as Producer suggests and Participant agrees. Participant may skip any request and may end the session at any time.
2. Commercial Audio Rights. Participant grants Producer the irrevocable, perpetual, worldwide right to record, edit, use, license, sublicense, and commercially distribute the audio recorded during the session for any lawful purpose, including but not limited to art projects, sound and video libraries, film, and digital media.
3. Conversation. The session is not intended to record conversation, but voices may be captured incidentally. Any identifiable conversation will be removed from material that is used commercially.
4. Video. Producer will record video during the session. Please select what may appear in the video (if none is selected, it defaults to Objects Only):

   [   ] Objects Only: Participant does not appear in any video Producer uses. The video shows only objects and surfaces (for example a cup, a table, a bench).

   [   ] Objects and Hands: Participant's hands may appear, but not Participant's face.

   [   ] Objects and Participant: Participant may appear, including Participant's face, and may be recognizable.

   If a camera captures more of Participant than selected, Producer will crop or delete that footage before it is used. Producer may use the video in Producer's art and sound and video library, and may commercially license and sublicense video in which Participant does not appear. Video in which Participant appears is licensed commercially only if Participant ticks this box:

5. Optional Credit. Participant may choose to be credited as a contributor to the project.

6. Personal Sound Clip. Producer will send Participant a personal excerpt of the session's audio for Participant's personal, non-commercial use, including sharing it on social media.
7. Compensation. Participation is voluntary. Producer will provide coffee, tea, or a pastry, and the personal sound clip. This Release does not create an employment relationship and is governed by Oregon law.
